1. Agreement to Terms

Welcome to Vitality Lab Gym ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website located at your-domain.com and our fitness facility services.

By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

2. Membership and Services

2.1 Membership Agreement

By purchasing a membership, you enter into a binding agreement with Vitality Lab Gym. Memberships are personal and non-transferable unless explicitly stated otherwise.

2.2 Membership Types

• Monthly memberships renew automatically on the same date each month
• Annual memberships are valid for 12 months from the purchase date
• Day passes provide access for a single day only
• Class packages must be used within the specified validity period

2.3 Payment Terms

All fees are due in advance. We accept payments via credit card, debit card, and bank transfer. Recurring memberships will be charged automatically to your registered payment method.

2.4 Cancellation and Refunds

Monthly memberships require 30 days written notice for cancellation. Annual memberships are non-refundable after 14 days from purchase. Unused portions of memberships are not refundable except as required by applicable law.

3. Facility Rules and Member Conduct

3.1 Access and Use

• Members must present valid membership cards or identification upon request
• Facility hours are subject to change with reasonable notice
• Equipment must be used properly and returned to designated areas
• Personal training sessions must be scheduled in advance

3.2 Prohibited Activities

The following activities are strictly prohibited:

• Harassment, intimidation, or inappropriate behavior toward staff or members
• Use of facility equipment while under the influence of drugs or alcohol
• Photography or video recording without prior written consent
• Commercial activities or solicitation without authorization
• Bringing unauthorized guests into the facility
• Damaging or misusing equipment or property

3.3 Suspension and Termination

We reserve the right to suspend or terminate memberships immediately for violation of these Terms, abusive behavior, or non-payment of fees, without refund.

4. Health and Safety

4.1 Medical Clearance

Members are responsible for ensuring they are physically capable of participating in gym activities. We recommend consulting with a healthcare provider before beginning any exercise program.

4.2 Assumption of Risk

Physical exercise involves inherent risks. By using our facilities, you acknowledge and accept these risks, including but not limited to: muscle strains, sprains, broken bones, heart attacks, and other injuries or death.

4.3 Emergency Procedures

In case of medical emergency, our staff will provide reasonable assistance and contact emergency services. Members are responsible for disclosing relevant medical conditions on their membership forms.

5. Limitation of Liability

5.1 Disclaimer of Warranties

Our services and facilities are provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted access to facilities or specific results from training programs.

5.2 Liability Waiver

To the maximum extent permitted by Croatian law, Vitality Lab Gym, its owners, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Use of our facilities, equipment, or services
• Personal injury or property damage
• Loss or theft of personal belongings
• Errors or omissions in fitness advice or instruction
• Interruption or cessation of services

5.3 Maximum Liability

In any event, our total liability shall not exceed the amount paid by you for membership fees in the three months preceding the claim.

5.4 Personal Property

We are not responsible for lost, stolen, or damaged personal property. Members use lockers and storage facilities at their own risk.

6. Intellectual Property Rights

6.1 Ownership

All content on our website and within our facilities, including but not limited to text, graphics, logos, images, videos, training programs, and software, is the property of Vitality Lab Gym and protected by Croatian and international copyright laws.

6.2 Restrictions

You may not:

• Reproduce, distribute, or display our content without written permission
• Use our trademarks, service marks, or branding without authorization
• Create derivative works based on our training programs or materials
• Reverse engineer or extract source code from our digital platforms

6.3 User Content

By submitting testimonials, reviews, or other content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such content for promotional purposes.

7. Website Terms of Use

7.1 Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

7.2 Prohibited Uses

You may not use our website to:

• Violate any applicable laws or regulations
• Transmit viruses, malware, or harmful code
• Attempt unauthorized access to our systems

9.2 Service Changes

We may modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice when practical. Membership fees may be adjusted with 30 days notice.

9.3 Facility Closures

The facility may be closed for maintenance, holidays, or unforeseen circumstances. We will provide advance notice when possible, but are not liable for temporary closures.

10. Termination

10.1 By Member

You may terminate your membership by providing written notice according to your membership type's cancellation policy. All outstanding fees must be paid.

10.2 By Vitality Lab Gym

We may terminate your membership immediately without refund if you:

• Violate these Terms or facility rules
• Engage in abusive or threatening behavior
• Fail to pay membership fees
• Provide false information
• Use services in a manner that endangers others

10.3 Effect of Termination

Upon termination, your right to access facilities ceases immediately. Provisions regarding liability, intellectual property, and dispute resolution survive termination.

11. Governing Law and Jurisdiction

11.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Croatia.

11.3 EU Rights

Nothing in these Terms affects your statutory rights as a consumer under European Union law or Croatian consumer protection legislation.

12. Dispute Resolution

12.1 Informal Resolution

In the event of any dispute, controversy, or claim arising from these Terms, parties agree to first attempt resolution through good-faith negotiation for a period of 30 days.

12.2 Mediation

If informal resolution fails, parties agree to attempt mediation before pursuing litigation. Mediation costs shall be shared equally unless otherwise agreed.

12.3 Legal Action

Either party may pursue legal action after exhausting informal resolution and mediation options, or in cases requiring immediate injunctive relief.

12.4 Class Action Waiver

To the extent permitted by law, all disputes must be brought individually and not as part of any class, consolidated, or representative action.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any membership agreement, constitute the entire agreement between you and Vitality Lab Gym regarding use of our services.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your membership without our written consent. We may assign our rights and obligations without restriction.

13.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.

13.6 Language

These Terms are provided in English. In case of any discrepancy between translated versions, the English version shall prevail.
